1st Circuit Remands ERISA Disability Case In Light Of Glenn
BOSTON – In light of the U.S. Supreme Court’s ruling in Metropolitan Life Insurance Co. v. Glenn, the First Circuit U.S. Court of Appeals on May 6 refined its abuse of discretion standard of review in cases where an Employee Retirement Income Security Act plan administrator both evaluates and pays claims to take into consideration the steps the plan administrator has taken to insulate the decision-making process against the effects of structural conflicts (Diane Denmark v. Liberty Life Assurance Company of Boston, et al., No. 05-2877, 1st Cir.).
