9th Circuit: Termination Of Benefits Because Of Mental Illness Reasonable
SAN FRANCISCO – The Ninth Circuit U.S. Court of Appeals on Aug. 18 in an unpublished opinion reversed a grant of summary judgment to a disability claimant, finding that the insurer’s decision to terminate benefits based on the plan’s 24-month benefit limitation period for mental illness was reasonable (Igor Gunn v. Reliance Standard Life Insurance Co., et al., No. 09-55089, 9th Cir.; 2010 U.S. App. LEXIS 17436).
