Judge: Issues Of Fact Exist On Whether Benefit Denial Was Reasonable
SAN JOSE, Calif. – A genuine dispute as to whether an insurer’s denial of partial disability benefits to a claimant with coronary artery disease was reasonable exists and precludes a grant of summary judgment on the breach of contract claim, a California federal judge ruled Feb. 26. The judge, however, granted the insurer summary judgment on the bad faith claim (Joseph Callahan v. Northwestern Mutual Life Insurance Co., et al., No. C-08-02956, N.D. Calif.; 2010 U.S. Dist. LEXIS 17232).
