Plan’s 3-Year Limitations Period Bars Action, 11th Circuit Holds

ATLANTA – An ERISA-governed disability plan’s three-year contractual limitations period bars an action seeking reinstatement of long-term disability benefits that were terminated after the claimant failed to secure Social Security disability benefits, the 11th Circuit U.S. Court of Appeals ruled June 17 (David Bennett v. Metropolitan Life Insurance Co., No.09-16127, 11th Cir.; 2010 U.S. App. LEXIS 12484).
