Reliance On Record Reviews, FCE Reasonable, New York Federal Judge Rules
NEW YORK – An ERISA-governed disability insurer’s reliance on record reviews and a functional capacity evaluation (FCE) in its decision to terminate benefits to a claimant with chronic back pain was reasonable, a New York federal judge ruled July 26 (Kelvin VanWright v. First Unum Life Insurance Co., No. 09-Civ-1186, S.D. N.Y.; 2010 U.S. Dist. LEXIS 76621).
